Terms of Service

1. Who we are

Thinkspark Sell ("we", "us", "the platform") is an online tool that lets creators sell digital products. It is operated as part of Thinkspark. By accessing the service at sell.thinkspark.dev, you agree to these terms.

2. Who can use the service

You must be at least 18 years old, have legal capacity to enter contracts, and have a valid payment method to make purchases. Sellers must additionally accept the Stripe Connected Account Agreement when applicable.

3. Accounts

We use email magic-link sign-in. You are responsible for the security of your inbox. Anyone with access to your inbox can sign in to your account.

4. Selling on the platform

As a seller, you keep ownership of everything you upload. You grant us a worldwide, non-exclusive license to host, display, transmit, and deliver your products to your buyers for the sole purpose of operating the service. You are responsible for the legality of what you sell and for handling any disputes with your buyers.

You may not use the service to sell illegal content, malware, content that infringes third-party rights, sexually explicit material involving minors, or anything prohibited by our payment provider's rules.

5. Subscription & payments

Thinkspark Sell is a SaaS subscription billed at €19/month (excl. VAT where applicable) with a 14-day free trial. The subscription is billed via Stripe and grants access to the seller dashboard, public storefront, file delivery, and APIs. Sellers can cancel at any time from the billing portal; access continues until the end of the current paid period. Any change to the subscription price will be communicated to existing sellers at least 30 days in advance.

Buyer payments are processed directly on the seller's own Stripe account via Stripe Connect. Thinkspark takes 0% commission on individual sales and never takes custody of buyer payments — funds settle on the seller's Stripe balance subject to Stripe's standard processing fees (~2.9% + 30¢ for cards) and the Stripe Connected Account Agreement. Each seller is the merchant of record for their own sales and is solely responsible for tax collection, invoicing, and refund decisions.

6. Refunds

Refunds are at the seller's discretion. Buyers should contact the seller first. We can assist as a last resort. When a refund is issued, any active download links are immediately invalidated.

7. Service availability

We do our best to keep the service available, but we don't guarantee uptime. The service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, our liability is limited to the fees you've paid to us in the prior 12 months.

8. Termination

You may stop using the service at any time. We may suspend accounts that violate these terms or our payment provider's rules. We will give you reasonable notice except in cases of fraud, abuse, or legal requirements.

9. Changes

We may update these terms occasionally. Material changes will be announced by email to registered users at least 14 days before they take effect. Continued use after that date constitutes acceptance.
